Have a look before : Bibliographic update : timing & coverage
The system allows you to check the consistency of your data with the public data (patents, designs and trademarks). The clock icon with a red dot indicates that suggestions are available to update your patent, design or trademark portfolio.
By clicking on this icon, a new window opens and suggests you the different updates that you can validate or decline.
The data comparison process is performed automatically every week (it is also possible to launch it manually via : Admin > Batch Launcher > Update Patent Suggestion or Update Trademark Suggestion). The update is currently launched automatically on Wednesdays.
Tips : You can switch to the next family by clicking on the arrows on the top left of the window.
The interface offers an overview of the suggested updates and the possibility to check manually suggestions via several external links (PDF, register and family view).
The application offers two types of updates:
- Updating the bibliographic data of existing patents in the application
- Suggestion of potentially missing patents to add new patents in the application
1) Updating the bibliographic data of existing patents in the application
Based on one of the numbers of an existing patent (application number and publication number), the application will check if all numbers, dates, number of claims and status are completed or in the right format with respect to the public data.
Update suggestion interface
- Validate or Decline update suggestions : By clicking on "Validate" the system will replace the "Current value" with the "Suggested value" in the Orbit Asset database. If you reject this update, the system will not suggest this update after the next data comparison.
- Connect or disconnect updates : The system allows you to connect or disconnect the link to the public data (and thus to the suggested data).
A "connected" patent (appearing with the icon and the green dot) is linked to the public data and is able to suggest updates. For example:
- If the system indicates "0 suggested update", this indicates that all bibliographic data is consistent with the published data.
- If the system indicates "3 suggested update", this indicates that the system has detected 3 fields with values different from the public values and suggests you to update them.
A "disconnected" patent (appearing with the icon and the red dot) is not linked to the public data because the system has not succeeded in linking it (usually because the filing number has been entered incorrectly). A disconnected patent will necessarily show "0 suggested update".
Tips : If the system does not return any suggestions while the patent is published or if it sends wrong suggestions, it is possible to manually disconnect / reconnect the patent. This manual connection mode is more complete and relies on the Orbit Intelligence search engine:
- no particular format is required (just make sure that the country code is not present in the search)
- it accepts any type of number ( publication, application...)
- it accepts the Orbit Intelligence search formalism by adding a # (examples: #71487044/FAN or #125969069/APID)
2) Suggestion of potentially missing patents to add new patents in the application
The system also proposes to add potential missing patents in your family " Additional patent(s) found in Questel's global patent database ". This action will add a new patent to your family and it is therefore imperative to check if this patent is not already present (if a patent in the family is not connected, it may be proposed to be added, see examples below).
Add potential missing patents
The suggestions in this section are based on the FAMPAT family structure. The application checks that all patents of the FAMPAT family are present in the family and suggests the apparently missing patents.
Before validating the addition of a new patent in the database, you can view the data of the suggested patent by clicking on "See details":
- By clicking on "Add this patent", the system will propose you to add this patent within this family and you can check before the validation finally the data that will be added.
- By clicking on "Reject this patent", for example if this patent is already part of your portfolio, the patent will not be added and the system will not propose you this update in the future.
Important notes and warnings :
- Adding a patent can create a duplicate in your database
Before adding, it is imperative to check beforehand if this patent is not already present in the portfolio to avoid duplication. In particular, it can be possible that a patent is suggested even though it is already present in the database.
The example below illustrates this case:
A KR patent is present in the family (as "Disconnected") and a KR patent is also suggested as missing. By clicking on "See details" of the suggested KR patent, we can see that the filing numbers of the 2 KR patents in this family are similar, but with a different format.
In this example, as the existing KR patent appears as "disconnected" (because the application has not been able to link this patent to the public data due to a missing filing number) the application has not been able to match this patent with the KR patent from the FAMPAT family.
Potential KR duplicate
In this case, it is better to connect the existing patent to get the right updates without losing its history (documents, tasks etc...) and not to add a duplicate. To do this, you can copy the publication number and then click to "connect" the KR patent and follow the instructions.
- Updates for EP validations are not automated
The system will natively propose for EP validations a disconnected state. It should be noted that in some countries, EP validations are however published and can be suggested as missing patents to the family. It is therefore particularly recommended to check if the suggestion to add an EP validation is justified or if it will create a duplicate.
The user can then :
- Consider that this protection is already in the family and ignore this suggested addition by clicking on "Reject this patent".
- Consider that this protection is already in the family and wish to connect the existing protection by using the "Connect" function (copy of the publication number)
- Consider that this protection is not in the family and that it should be added by clicking on "Add this patent"
